Child-Resistant Packaging Rules: US vs Canada Compared

If you sell cannabis products in North America, child-resistant packaging is not optional — and the rules differ on either side of the border. This guide compares US and Canadian CR requirements so you can specify packaging that clears both.

Why CR packaging exists

Child-resistant (CR) closures are designed to be significantly difficult for children under five to open, while remaining usable for adults. For cannabis, they are mandated because dried flower, edibles and concentrates can look like ordinary sweets.

The United States: a federal standard plus state layers

The US baseline comes from the Poison Prevention Packaging Act (PPPA), enforced by the CPSC. Closures must satisfy 16 CFR 1700 testing:

• Child test — at least 85% of children in a test panel cannot open the package in the allotted time
• Adult test — at least 90% of adults in the panel can open and properly reclose it

On top of the federal rule, each state adds its own requirements. Commonly cited references include ASTM D3475 (the standard classification for CR closures) and state-specific rules on opacity, tamper evidence and labelling.

Canada: Health Canada sets the rules nationally

Canada regulates cannabis federally under the Cannabis Act and its regulations. Packaging must be:

• Child-resistant — meeting the CR requirements set out in the regulations and tested to recognised standards
• Tamper-evident
• Plain and uniform — strict limits on colours, graphics and branding
• Labelled — with health warnings, THC/CBD content and the standardised cannabis symbol

Canada's branding restrictions are notably stricter than most US states: logos are limited, and packaging cannot appeal to young people.

What this means for your packaging spec

1. Ask for the CR test report — a supplier should be able to show certification for the exact bottle-plus-closure combination, not just the cap.
2. Test the combination — CR performance depends on bottle neck finish and closure together. A certified cap on an untested bottle may fail.
3. Confirm which standard — if you ship across the border, specify closures tested to both US and recognised CR standards.
4. Document everything — keep test reports, specifications and supplier certificates on file. Regulators ask for them.
5. Plan for state differences — if you sell in multiple states, design to the strictest requirement rather than the loosest.
